1. Agreement to Terms

These Terms of Use (“Terms”) govern your access to and use of SubVox (the “App”), provided by Chris Canfield Entertainment (“we,” “us,” “our”). By installing or using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Eligibility

SubVox is intended for users 13 years of age or older. By using SubVox, you represent and warrant that you meet this age requirement.

3. Description of the App

SubVox is a voice-activated utility for iOS and watchOS that captures audio only when explicitly initiated by the user, performs on-device speech-to-text processing, extracts text between user-defined keywords, and allows users to transmit extracted data to third-party integrations of their choosing. All primary processing occurs locally on your device unless you choose to send data externally.

SubVox also includes an optional conversational AI feature. If you enable this feature and provide your own third-party AI provider credentials, text may be transmitted directly from your device to that provider. SubVox does not receive, store, or process that data on its own servers.

For Entertainment and Personal Utility Only: SubVox is provided for personal use and entertainment. It is not intended or suitable for professional, legal, medical, clinical, surveillance, accessibility, commercial, or safety-critical environments.

4. User Responsibilities

4.1 Lawful Use Only

You agree to use SubVox in compliance with all applicable laws, including obtaining any required consent before recording or processing the voices of others. You are solely responsible for compliance with all local, state, federal, and international privacy and recording laws.

4.2 Prohibited Uses

You may not:

• Use the App to violate privacy, consent, surveillance, or wiretapping laws

• Use the App in any malicious, fraudulent, or harmful manner

• Reverse engineer, decompile, or attempt to derive source code

• Use the App in safety-critical or emergency scenarios

• Use the App to store or transmit sensitive personal information without authorization

5. Audio Capture & Background Operation

SubVox may capture audio when the App is in the foreground, when the screen is off, or via the Apple Watch companion. However, all audio capture requires explicit user action. The App does not automatically record or monitor audio.

6. User-Provided Content

The App may process content you choose to speak into it (“User Content”). By providing User Content:

• You acknowledge that any personal information spoken into the App is processed locally and temporarily

• You understand that SubVox does not store or transmit your audio, transcripts, or extracted text to the developer

• Any transmission of User Content to third-party services occurs only at your explicit direction

• You are solely responsible for the content you choose to speak or send

SubVox functions strictly as a user-controlled tool.

7. Third-Party Integrations

SubVox may connect to third-party services such as MysterSmith, Inject, and others selected by you.

• Integration keys and credentials are stored securely in the iOS Keychain

• SubVox does not access or collect these credentials

• We are not responsible for the data practices, privacy policies, security, or functionality of third-party services

• You must review and agree to the terms and privacy policies of any services you enable

• All transmissions to third parties occur solely at your direction

8. Data Practices

SubVox does not collect, store, or transmit personal data on its own servers. For more detail, please refer to our Privacy Policy, which is incorporated into these Terms.

9. Intellectual Property

All intellectual property rights in SubVox — including its design, features, software code, logo, and documentation — belong exclusively to Chris Canfield Entertainment. You may not copy, modify, distribute, sublicense, or create derivative works of the App.

10. Disclaimers

10.1 General Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY OR RELIABILITY OF TRANSCRIPTION, SUCCESSFUL KEYWORD DETECTION, COMPATIBILITY WITH THIRD-PARTY SERVICES, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Entertainment-Only Disclaimer

SubVox is designed for entertainment and personal use. It is not a professional tool and must not be relied upon for legal, medical, safety-critical, evidentiary, compliance, or emergency uses.

10.3 No Responsibility for User Actions

We are not responsible for any content you choose to speak into the App, any data you send to third-party services, or any violations of privacy or recording laws by you.

11. Limitation of Liability

To the fullest extent permitted by California law, we shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of data, revenue, business, or reputation. Our total liability for any claim arising out of or related to the App shall not exceed the amount you paid (if any) to purchase or use the App. Some jurisdictions do not allow certain limitations; in those cases, limitations apply only to the maximum extent permitted.

12. Indemnification

You agree to indemnify and hold harmless Chris Canfield Entertainment from any claims, damages, liabilities, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the App

• Your violation of these Terms

• Your breach of applicable laws

• Your transmission of content to third-party services

13. Termination

We may suspend or terminate your access to SubVox at any time if you violate these Terms or misuse the App. You may discontinue use at any time by deleting the App.

14. Changes to the Terms

We may update these Terms from time to time. Updated Terms will take effect when posted within the App, on our website, or as required by law.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree that any disputes shall be resolved in state or federal courts located in California.
